2. Geltungsbereich

Diese Bedingungen gelten für die Nutzung der App Calonic, mit und ohne Konto. Für Käufe gelten zusätzlich die Bedingungen des App Stores, über den du kaufst. Lädst du Calonic aus dem Apple App Store, gilt außerdem der Standard-Lizenzvertrag von Apple.

Calonic richtet sich an Personen ab 18 Jahren.

3. Was Calonic leistet

Calonic ist ein Kalorientracker. Du beschreibst eine Mahlzeit per Text oder Foto, eine KI schätzt Kalorien und Nährwerte, und die App summiert sie zu deinem Tagesstand. Ohne Konto kannst du die App mit einer begrenzten Zahl von Analysen ausprobieren. Mit Calonic Premium erhältst du unter anderem ein persönliches Tagesziel, die Tagesbilanz, das Ernährungs- und Gewichtstagebuch und mehr Analysen pro Tag. Den aktuellen Umfang zeigt dir die App vor dem Kauf.

Wir entwickeln Calonic laufend weiter. Funktionen können sich dabei ändern. Wesentliche Funktionen, für die du bezahlt hast, nehmen wir dir während eines laufenden Abozeitraums nicht weg. Wir bemühen uns um einen störungsfreien Betrieb, können eine ununterbrochene Verfügbarkeit aber nicht zusagen, etwa bei Wartung oder Störungen bei unseren Dienstleistern.

4. KI-Schätzungen und Gesundheit

Wichtig: Alle Nährwerte in Calonic sind Schätzungen. Sie können deutlich von den tatsächlichen Werten abweichen, vor allem wenn die Beschreibung oder das Foto wenig Details enthält. Je genauer deine Angaben, desto besser die Schätzung.

Calonic ist ein Lifestyle-Produkt und kein Medizinprodukt. Die App ersetzt keine ärztliche oder ernährungsmedizinische Beratung. Sie ist nicht dafür gedacht, extreme Diäten zu unterstützen. Wenn du eine Erkrankung hast, schwanger bist, eine Essstörung hattest oder Medikamente nimmst, deren Wirkung von der Ernährung abhängt, sprich vor einer Ernährungsumstellung mit einer Ärztin oder einem Arzt.

5. Dein Konto

Bitte mach bei der Registrierung und im Profil zutreffende Angaben, denn dein Tagesziel wird daraus berechnet. Halte deine Zugangsdaten geheim. Du kannst dein Konto jederzeit in der App unter Einstellungen, „Konto löschen“, entfernen.

6. Abonnement, Probewoche und Zahlung

Calonic Premium kaufst du ausschließlich über den Apple App Store oder Google Play. Die Zahlung wickelt der jeweilige Store ab. Preis und Laufzeit siehst du vor dem Kauf in der App.
Das Abo verlängert sich automatisch um die gewählte Laufzeit, wenn du es nicht mindestens 24 Stunden vor Ablauf kündigst. Kündigen kannst du jederzeit in den Abo-Einstellungen deines Apple- oder Google-Kontos. Das Löschen der App oder deines Calonic-Kontos beendet das Abo nicht.
Bietet die App eine kostenlose Probewoche an, geht sie in ein bezahltes Abo über, wenn du nicht vor ihrem Ende kündigst.
Dein Abo gilt für dein Calonic-Konto, also auf iPhone und Android, wenn du dich mit demselben Konto anmeldest. Verwalten und kündigen kannst du es nur über den Store, in dem du es abgeschlossen hast.
Erstattungen und ein gesetzliches Widerrufsrecht richten sich nach den Bedingungen von Apple bzw. Google, über die der Kauf läuft.

7. Zulässige Nutzung

Du nutzt Calonic nur für dich selbst und nur für rechtmäßige Zwecke. Nicht erlaubt ist insbesondere:

Inhalte hochzuladen, die rechtswidrig sind oder die Rechte anderer verletzen,
die App automatisiert abzufragen, ihre Begrenzungen zu umgehen oder ihre Schutzmechanismen zu stören,
die App oder ihre Server nachzubauen, zu dekompilieren oder zu überlasten, soweit das Gesetz es nicht ausdrücklich erlaubt.

8. Rechte

Die App mit Software, Design, Texten, Grafiken und Logos gehört der Certyfact UG und ist urheberrechtlich geschützt. Du erhältst ein einfaches, nicht übertragbares Recht, Calonic für private Zwecke zu nutzen. Deine eigenen Inhalte, etwa Fotos und Beschreibungen deiner Mahlzeiten, bleiben deine. Du erlaubst uns, sie zu verarbeiten, soweit das für die Funktionen der App nötig ist.

9. Sperrung und Beendigung

Verstößt jemand erheblich gegen diese Bedingungen, können wir das Konto nach vorheriger Warnung sperren oder kündigen. Bei schweren Verstößen, etwa rechtswidrigen Inhalten oder Angriffen auf die App, auch ohne Warnung. Du kannst die Nutzung jederzeit beenden, indem du dein Konto löschst. Ein laufendes Abo kündigst du zusätzlich im Store.

10. Haftung

Wir haften unbeschränkt bei Vorsatz und grober Fahrlässigkeit, bei Verletzung von Leben, Körper oder Gesundheit und nach dem Produkthaftungsgesetz. Bei leichter Fahrlässigkeit haften wir nur, wenn wir eine wesentliche Vertragspflicht verletzen, also eine Pflicht, deren Erfüllung die Nutzung der App erst ermöglicht und auf die du vertrauen darfst. In diesem Fall ist die Haftung auf den vorhersehbaren, vertragstypischen Schaden begrenzt. Im Übrigen ist die Haftung ausgeschlossen.

12. Änderungen dieser Bedingungen

Wir passen diese Bedingungen an, wenn sich die App oder die Rechtslage ändert. Über wesentliche Änderungen informieren wir dich rechtzeitig in der App und bitten dich dort um Zustimmung. Stimmst du nicht zu, kannst du dein Abo zum Ende der Laufzeit kündigen.

13. Anwendbares Recht und Streitbeilegung

Es gilt deutsches Recht. Wenn du Verbraucher bist und deinen gewöhnlichen Aufenthalt in einem anderen Land hast, behältst du den Schutz der zwingenden Verbraucherschutzvorschriften dieses Landes. Wir sind nicht bereit und nicht verpflichtet, an Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen. Bei Fragen oder Problemen schreib uns einfach an mz@calonic.com.

2. Scope

These terms apply to your use of the Calonic app, with or without an account. Purchases are also subject to the terms of the app store you buy from. If you download Calonic from the Apple App Store, Apple's Standard License Agreement applies as well.

Calonic is intended for people aged 18 and over.

3. What Calonic does

Calonic is a calorie tracker. You describe a meal in text or with a photo, an AI estimates calories and nutrients, and the app adds them up to your daily total. Without an account you can try the app with a limited number of analyses. Calonic Premium adds, among other things, a personal daily goal, a daily balance, the food and weight diary and more analyses per day. The app shows you the current scope before you buy.

We keep developing Calonic, so features may change. We will not remove essential features you have paid for during a running subscription period. We aim for smooth operation but cannot promise uninterrupted availability, for example during maintenance or outages at our service providers.

4. AI estimates and health

Important: All nutrition values in Calonic are estimates. They can differ considerably from the actual values, especially if the description or photo contains little detail. The more precise your input, the better the estimate.

Calonic is a lifestyle product, not a medical device. It does not replace advice from a doctor or a qualified nutrition professional, and it is not meant to support extreme diets. If you have a medical condition, are pregnant, have had an eating disorder or take medication affected by your diet, talk to a doctor before changing how you eat.

5. Your account

Please enter accurate information when you register and in your profile, as your daily goal is calculated from it. Keep your login details secret. You can delete your account at any time in the app under Settings, "Delete account".

6. Subscription, free trial and payment

You buy Calonic Premium only through the Apple App Store or Google Play. The store handles payment. The app shows you price and term before you buy.
The subscription renews automatically for the chosen term unless you cancel at least 24 hours before it ends. You can cancel at any time in the subscription settings of your Apple or Google account. Deleting the app or your Calonic account does not end the subscription.
If the app offers a free trial week, it turns into a paid subscription unless you cancel before it ends.
Your subscription belongs to your Calonic account, so it works on iPhone and Android when you sign in with the same account. You can manage and cancel it only in the store where you bought it.
Refunds and any statutory right of withdrawal are governed by the terms of Apple or Google, through which the purchase is made.

7. Acceptable use

You use Calonic only for yourself and only for lawful purposes. In particular, you may not:

upload content that is unlawful or infringes the rights of others,
query the app automatically, bypass its limits or interfere with its protection mechanisms,
copy, decompile or overload the app or its servers, except where the law expressly permits it.

8. Rights

The app, including software, design, texts, graphics and logos, belongs to Certyfact UG and is protected by copyright. You receive a simple, non-transferable right to use Calonic for private purposes. Your own content, such as photos and descriptions of your meals, remains yours. You allow us to process it as far as needed to provide the app's features.

9. Suspension and termination

If someone seriously violates these terms, we may suspend or terminate the account after a prior warning, and without warning in severe cases such as unlawful content or attacks on the app. You can stop using Calonic at any time by deleting your account. You cancel a running subscription separately in the store.

10. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act. For slight negligence we are liable only if we breach an essential contractual obligation, meaning an obligation whose fulfilment makes using the app possible in the first place and on which you may rely. In that case liability is limited to the foreseeable damage typical for this type of contract. Otherwise liability is excluded.

How we handle your data is described in our Privacy Policy.

12. Changes to these terms

We update these terms when the app or the law changes. We will inform you of material changes in the app in good time and ask for your consent there. If you do not agree, you can cancel your subscription at the end of its term.

13. Governing law and dispute resolution

German law applies. If you are a consumer with your habitual residence in another country, you keep the protection of that country's mandatory consumer protection rules. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. If you have questions or problems, just write to mz@calonic.com.
