Datenschutzerklärung für die App Calonic

2. Überblick

Calonic ist ein Kalorientracker. Du erfasst Mahlzeiten per Text oder Foto, eine KI schätzt die Nährwerte, und die App addiert sie zu deinem Tagesstand. Diese Erklärung zeigt dir, welche Daten dabei anfallen, wofür wir sie nutzen, wer sie erhält und welche Rechte du hast.

Kurz gesagt: Wir nutzen deine Daten nur, um die App zu betreiben. Wir verkaufen keine Daten, zeigen keine Werbung und setzen keine Analyse- oder Tracking-Dienste ein. Für die KI-Auswertung leiten wir deine Mahlzeiten über unseren eigenen Server an OpenAI weiter. Deinen Namen und deine E-Mail-Adresse erhält OpenAI nie.

3. Nutzung ohne Konto (Testmodus)

Du kannst Calonic ausprobieren, ohne ein Konto anzulegen. Damit das funktioniert, verarbeiten wir:

eine Gerätekennung, die das Betriebssystem der App zur Verfügung stellt (unter iOS die „Identifier for Vendor“, unter Android die App-bezogene Android-ID). Sie ist keine Werbe-ID und kann nicht app-übergreifend verwendet werden,
eine anonyme Nutzerkennung von Firebase Authentication,
die Mahlzeiten, die du im Chat eingibst (Text und Fotos), und die geschätzten Nährwerte.

Chats ohne Konto werden nach 30 Tagen automatisch gelöscht. Legst du innerhalb dieser Zeit ein Konto an, übernehmen wir die Einträge von diesem Gerät in dein Konto, damit nichts verloren geht.

Rechtsgrundlage: Art. 6 Abs. 1 lit. b DSGVO (Bereitstellung der von dir angefragten Funktion).

4. Daten in deinem Konto

4.1 Anmeldung

Du kannst dich mit E-Mail-Adresse, mit „Mit Apple anmelden“ oder mit Google anmelden. Wir erhalten dabei deine E-Mail-Adresse (bei Apple auf Wunsch eine anonyme Weiterleitungsadresse) und, falls übermittelt, deinen Namen.

4.2 Profildaten

Für dein persönliches Tagesziel kannst du folgende Angaben machen: Name, Geburtsdatum (Monat und Jahr), Körpergröße, Geschlecht, Aktivitätstyp, aktuelles Gewicht und Zielgewicht.

4.3 Ernährungsdaten

Wir speichern deine Mahlzeiten (Textbeschreibungen und Fotos) und die daraus geschätzten Nährwerte, zum Beispiel Kalorien, Kohlenhydrate, Fett, Protein, Zucker, Ballaststoffe, gesättigte Fette, Natrium, Koffein, Alkohol, Wasser und CO2-Abdruck. Fotos speichern wir zusammen mit dem Eintrag, damit du sie jederzeit wieder ansehen kannst.

4.4 Gewicht, Favoriten und Intervallfasten

Wenn du das Gewichtstagebuch nutzt, speichern wir deine Gewichtseinträge mit Datum. Speisen, die du als Favorit markierst, speichern wir in deinem Profil. Beim Intervallfasten speichern wir deine Fastenzeiten und Essensfenster.

4.5 Einwilligung in die Verarbeitung von Gesundheitsdaten

Angaben wie Gewicht, Körpergröße und Ernährung können Gesundheitsdaten im Sinne von Art. 9 DSGVO sein. Bevor wir sie in deinem Konto speichern, bitten wir dich deshalb um deine ausdrückliche Einwilligung. Als Nachweis speichern wir die Version dieser Erklärung, die du bestätigt hast, den Zeitpunkt, die Gerätekennung, die Plattform (iOS oder Android), die App-Version und die Sprache. Du kannst deine Einwilligung jederzeit widerrufen, indem du dein Konto löschst oder uns schreibst.

Rechtsgrundlage für Abschnitt 4: Art. 6 Abs. 1 lit. b DSGVO (Vertragserfüllung) und für Gesundheitsdaten Art. 9 Abs. 2 lit. a DSGVO (ausdrückliche Einwilligung). Die Speicherung des Einwilligungsnachweises beruht auf Art. 6 Abs. 1 lit. c DSGVO in Verbindung mit Art. 7 Abs. 1 DSGVO.

5. KI-gestützte Auswertung (OpenAI)

Die Nährwerte deiner Mahlzeiten und die KI-Empfehlung für dein Tagesziel berechnet ein Sprachmodell von OpenAI. Die App sendet deine Anfrage dafür nicht direkt an OpenAI, sondern an unseren eigenen Server (Google Cloud Functions, Region Belgien, EU). Erst dieser leitet die Anfrage an OpenAI weiter. OpenAI sieht deshalb weder deine IP-Adresse noch deine Nutzerkennung.

An OpenAI übermittelt werden:

bei der Erfassung einer Mahlzeit: dein Text, gegebenenfalls das Foto und die eingestellte Sprache,
bei der KI-Empfehlung für dein Tagesziel: aktuelles Gewicht, Zielgewicht, Körpergröße, Aktivitätstyp und dein Ziel (zum Beispiel abnehmen oder Gewicht halten).

Name, E-Mail-Adresse und Geburtsdatum werden nicht an OpenAI übermittelt. Bitte schreib auch selbst keine solchen Angaben in den Chat.

OpenAI, L.L.C. (San Francisco, USA) verarbeitet die Daten als unser Auftragsverarbeiter. Daten, die über die OpenAI-Schnittstelle gesendet werden, nutzt OpenAI nach eigenen Angaben nicht zum Training seiner Modelle und speichert sie höchstens 30 Tage zur Missbrauchserkennung. Die Übermittlung in die USA ist durch Standardvertragsklauseln der EU-Kommission nach Art. 46 DSGVO abgesichert.

Um Missbrauch und unverhältnismäßige Kosten zu verhindern, zählt unser Server die KI-Anfragen pro Nutzer und Tag. Diese Zähler werden nach 30 Tagen automatisch gelöscht.

Rechtsgrundlage: Art. 6 Abs. 1 lit. b DSGVO, für Gesundheitsdaten Art. 9 Abs. 2 lit. a DSGVO (deine Einwilligung aus Abschnitt 4.5). Für den Anfragezähler Art. 6 Abs. 1 lit. f DSGVO (berechtigtes Interesse an einem sicheren und wirtschaftlichen Betrieb).

6. Hosting und Datenspeicherung (Google Firebase)

Calonic nutzt Firebase von Google als Backend. Im Einsatz sind:

Firebase Authentication (Anmeldung),
Cloud Firestore (Speicherung deiner Daten),
Cloud Functions in der Region Belgien (unser Server für KI-Anfragen und Einwilligungen),
Firebase App Check (Schutz vor Missbrauch, siehe Abschnitt 7).

Deine Kontodaten und Einträge speichert Cloud Firestore in Rechenzentren von Google in den USA (Region „nam5“). Unser Server, der KI-Anfragen und Einwilligungen verarbeitet, läuft in Belgien. Google Ireland Limited bzw. Google LLC verarbeitet die Daten als unser Auftragsverarbeiter nach Art. 28 DSGVO. Für die Übermittlung in die USA gelten das EU-US Data Privacy Framework, unter dem Google zertifiziert ist, und ergänzend die Standardvertragsklauseln der EU-Kommission. Unser Server protokolliert technische Ereignisse wie Fehler zusammen mit der Nutzerkennung, um den Betrieb sicherzustellen. Diese Protokolle löscht Google nach 30 Tagen. Rechtsgrundlage: Art. 6 Abs. 1 lit. b DSGVO sowie Art. 6 Abs. 1 lit. f DSGVO (berechtigtes Interesse an einer sicheren und zuverlässigen Infrastruktur).

7. Schutz vor Missbrauch (App Check)

Damit nur die echte Calonic-App unseren Server nutzen kann, prüft Firebase App Check bei jeder Anfrage, ob sie von einer unveränderten App auf einem echten Gerät kommt. Dafür nutzt die App unter iOS die Dienste App Attest und DeviceCheck von Apple, unter Android die Play Integrity API von Google. Apple bzw. Google erhalten dabei technische Informationen über App und Gerät, aber keine Inhalte aus Calonic.

Rechtsgrundlage: Art. 6 Abs. 1 lit. f DSGVO (berechtigtes Interesse am Schutz vor Missbrauch).

8. Apple Health und Health Connect

Auf deinen Wunsch überträgt Calonic Nährwerte, Gewicht und Körpergröße an Apple Health (iOS) bzw. Health Connect (Android). Die Übertragung läuft nur in eine Richtung, Calonic liest keine Daten aus diesen Plattformen. Die Funktion ist standardmäßig aus und wird erst aktiv, wenn du sie einschaltest und die Berechtigung erteilst. Du kannst sie in den Einstellungen deines Geräts jederzeit wieder entziehen.

Rechtsgrundlage: Art. 6 Abs. 1 lit. a und Art. 9 Abs. 2 lit. a DSGVO (Einwilligung).

9. Abonnement und Zahlung

Abonnements werden ausschließlich über den Apple App Store bzw. Google Play abgewickelt. Wir erhalten keine Zahlungsdaten wie Kreditkarten- oder Kontonummern. Um zu prüfen, ob ein Kauf gültig ist, verarbeiten wir den Kaufnachweis:

unter iOS prüft die App den Kauf direkt auf deinem Gerät bei Apple,
unter Android prüft die App den Kauf direkt auf deinem Gerät bei Google Play. Es ist kein weiterer Dienstleister beteiligt.

App-Versionen vor 1.7.6 haben unter Android Paketname, Produkt-ID und Kauf-Token an einen Prüfserver von AlphaSquad Technologies, dem ursprünglichen Entwickler der App, gesendet, der den Kauf bei Google bestätigt hat. Dabei hat AlphaSquad auch deine IP-Adresse erhalten. Inhalte aus Calonic wie Mahlzeiten, Profil- oder Gesundheitsdaten wurden nicht übermittelt.

In deinem Konto speichern wir, welches Abo du hast und bis wann es läuft. So gilt dein Abo auch auf einem Gerät mit dem anderen Betriebssystem, wenn du dort mit demselben Konto angemeldet bist. Für die Zahlung selbst gelten die Datenschutzbestimmungen von Apple bzw. Google.

10. Benachrichtigungen

Erinnerungen an Mahlzeiten und an Beginn und Ende deiner Fastenzeiten erzeugt die App lokal auf deinem Gerät. Dafür werden keine Daten an unsere Server gesendet. Du kannst Benachrichtigungen in der App oder in den Einstellungen deines Geräts abschalten.

11. Daten auf deinem Gerät

Damit die App schnell startet, speichert sie einen Teil deiner Daten zwischen, etwa deinen Chatverlauf, dein Profil und deine Einstellungen. Diese Daten bleiben auf deinem Gerät und werden gelöscht, wenn du dich abmeldest oder die App entfernst.

12. Kein Tracking, keine Werbung

Calonic verwendet keine Analyse- oder Tracking-Dienste und keine Werbe-IDs (IDFA/GAID). Es sind keine Drittanbieter-SDKs für Werbung, Absturzberichte oder A/B-Tests eingebunden.

14. Datensicherheit

Alle Verbindungen zwischen App und Server sind verschlüsselt. Der Schlüssel für die OpenAI-Schnittstelle liegt nur auf unserem Server und nicht in der App. Zum Schutz vor unbefugten Zugriffen setzen wir Firebase App Check ein und verschärfen die Zugriffsregeln der Datenbank schrittweise.

15. Speicherdauer

Kontodaten speichern wir, solange dein Konto besteht. Löschst du dein Konto, entfernen wir deine Daten von unseren Servern.
Chats ohne Konto werden nach 30 Tagen gelöscht.
KI-Anfragezähler und Server-Protokolle werden nach 30 Tagen gelöscht.
Bei OpenAI gespeicherte Anfragen werden nach höchstens 30 Tagen gelöscht.
Einwilligungsnachweise bewahren wir auf, solange wir die Einwilligung nachweisen müssen.

16. Deine Rechte

Nach der DSGVO hast du das Recht auf Auskunft (Art. 15), Berichtigung (Art. 16), Löschung (Art. 17), Einschränkung der Verarbeitung (Art. 18), Datenübertragbarkeit (Art. 20) und Widerspruch gegen Verarbeitungen auf Grundlage berechtigter Interessen (Art. 21). Eine Einwilligung kannst du jederzeit mit Wirkung für die Zukunft widerrufen (Art. 7 Abs. 3).

Dein Konto und alle zugehörigen Daten kannst du direkt in der App unter Einstellungen, „Konto löschen“, entfernen. Für alle anderen Anliegen schreib uns an mz@calonic.com.

Du kannst dich außerdem bei einer Datenschutzaufsichtsbehörde beschweren (Art. 77). Zuständig für uns ist das Bayerische Landesamt für Datenschutzaufsicht (BayLDA), Promenade 18, 91522 Ansbach.

17. Änderungen

Wir passen diese Erklärung an, wenn sich die App, die Datenverarbeitung oder die Rechtslage ändert. Die aktuelle Fassung findest du immer in der App und auf calonic.com. Bei wesentlichen Änderungen bitten wir dich in der App erneut um deine Bestätigung.

2. Overview

Calonic is a calorie tracker. You log meals by text or photo, an AI estimates the nutritional values, and the app adds them up to your daily balance. This policy explains which data is involved, what we use it for, who receives it and what rights you have.

In short: We use your data only to run the app. We do not sell data, show ads or use analytics or tracking services. For the AI analysis, your meals are routed through our own server to OpenAI. OpenAI never receives your name or email address.

3. Using the app without an account (trial mode)

You can try Calonic without creating an account. To make this work, we process:

a device identifier provided to the app by the operating system (the "Identifier for Vendor" on iOS, the app-scoped Android ID on Android). It is not an advertising ID and cannot be used across apps,
an anonymous user ID from Firebase Authentication,
the meals you enter in the chat (text and photos) and the estimated nutritional values.

Chats without an account are deleted automatically after 30 days. If you create an account within that period, the entries from this device are moved into your account so nothing is lost.

Legal basis: Art. 6(1)(b) GDPR (providing the feature you requested).

4. Data in your account

4.1 Sign-in

You can sign in with your email address, with "Sign in with Apple" or with Google. We receive your email address (with Apple, optionally an anonymous relay address) and, if provided, your name.

4.2 Profile data

For your personal daily goal you can provide: name, date of birth (month and year), height, gender, activity type, current weight and target weight.

4.3 Nutrition data

We store your meals (text descriptions and photos) and the estimated nutritional values, for example calories, carbohydrates, fat, protein, sugar, fibre, saturated fat, sodium, caffeine, alcohol, water and carbon footprint. Photos are stored with the entry so you can view them again at any time.

4.4 Weight, favourites and intermittent fasting

If you use the weight diary, we store your weight entries with their date. Meals you mark as favourites are stored in your profile. For intermittent fasting, we store your fasting periods and eating windows.

4.5 Consent to the processing of health data

Information such as weight, height and nutrition can be health data within the meaning of Art. 9 GDPR. Before we store it in your account, we therefore ask for your explicit consent. As proof, we store the version of this policy you accepted, the time, the device identifier, the platform (iOS or Android), the app version and the language. You can withdraw your consent at any time by deleting your account or by contacting us.

Legal basis for section 4: Art. 6(1)(b) GDPR (performance of contract) and, for health data, Art. 9(2)(a) GDPR (explicit consent). Storing the proof of consent is based on Art. 6(1)(c) in conjunction with Art. 7(1) GDPR.

5. AI-based analysis (OpenAI)

The nutritional values of your meals and the AI recommendation for your daily goal are calculated by a language model from OpenAI. The app does not send your request to OpenAI directly but to our own server (Google Cloud Functions, region Belgium, EU), which then forwards it to OpenAI. OpenAI therefore sees neither your IP address nor your user ID.

The following is sent to OpenAI:

when you log a meal: your text, the photo if any, and the app language,
for the AI recommendation of your daily goal: current weight, target weight, height, activity type and your goal (for example lose or maintain weight).

Your name, email address and date of birth are not sent to OpenAI. Please do not enter such details in the chat yourself.

OpenAI, L.L.C. (San Francisco, USA) processes the data as our processor. According to OpenAI, data sent through its API is not used to train its models and is retained for up to 30 days for abuse monitoring. The transfer to the USA is safeguarded by the European Commission's Standard Contractual Clauses under Art. 46 GDPR.

To prevent abuse and disproportionate costs, our server counts AI requests per user and day. These counters are deleted automatically after 30 days.

Legal basis: Art. 6(1)(b) GDPR, for health data Art. 9(2)(a) GDPR (your consent under section 4.5). For the request counter, Art. 6(1)(f) GDPR (legitimate interest in secure and economical operation).

6. Hosting and data storage (Google Firebase)

Calonic uses Google Firebase as its backend, namely:

Firebase Authentication (sign-in),
Cloud Firestore (storage of your data),
Cloud Functions in the Belgium region (our server for AI requests and consents),
Firebase App Check (abuse protection, see section 7).

Cloud Firestore stores your account data and entries in Google data centres in the USA (region "nam5"). Our server that handles AI requests and consents runs in Belgium. Google Ireland Limited or Google LLC processes the data as our processor under Art. 28 GDPR. The transfer to the USA is covered by the EU-US Data Privacy Framework, under which Google is certified, and supplementary Standard Contractual Clauses of the European Commission. Our server logs technical events such as errors together with the user ID to keep the service running. Google deletes these logs after 30 days. More at policies.google.com/privacy.

Legal basis: Art. 6(1)(b) GDPR and Art. 6(1)(f) GDPR (legitimate interest in a secure and reliable infrastructure).

7. Abuse protection (App Check)

To ensure that only the genuine Calonic app can use our server, Firebase App Check verifies with every request that it comes from an unmodified app on a real device. On iOS the app uses Apple's App Attest and DeviceCheck services, on Android Google's Play Integrity API. Apple or Google receive technical information about the app and device, but no content from Calonic.

Legal basis: Art. 6(1)(f) GDPR (legitimate interest in protection against abuse).

8. Apple Health and Health Connect

At your request, Calonic writes nutritional values, weight and height to Apple Health (iOS) or Health Connect (Android). Data flows in one direction only. Calonic does not read any data from these platforms. The feature is off by default and only becomes active when you switch it on and grant permission. You can revoke the permission at any time in your device settings.

Legal basis: Art. 6(1)(a) and Art. 9(2)(a) GDPR (consent).

9. Subscription and payment

Subscriptions are handled exclusively through the Apple App Store or Google Play. We do not receive payment details such as card or account numbers. To verify that a purchase is valid, we process the proof of purchase:

on iOS, the app verifies the purchase directly with Apple on your device,
on Android, the app verifies the purchase directly with Google Play on your device. No other service provider is involved.

App versions before 1.7.6 sent the package name, product ID and purchase token on Android to a verification server operated by AlphaSquad Technologies, the original developer of the app, which confirmed the purchase with Google. AlphaSquad also received your IP address in the process. No Calonic content such as meals, profile or health data was transmitted.

In your account we store which subscription you have and until when it runs. This way your subscription also applies on a device with the other operating system when you sign in there with the same account. The privacy policies of Apple and Google apply to the payment itself.

10. Notifications

Meal reminders and reminders for the start and end of your fasting periods are created locally on your device. No data is sent to our servers for this. You can turn notifications off in the app or in your device settings.

11. Data on your device

To start quickly, the app caches part of your data, such as your chat history, profile and settings. This data stays on your device and is removed when you sign out or uninstall the app.

12. No tracking, no ads

Calonic does not use analytics or tracking services or advertising IDs (IDFA/GAID). No third-party SDKs for advertising, crash reporting or A/B testing are included.

14. Data security

All connections between the app and the server are encrypted. The key for the OpenAI interface is kept only on our server and not in the app. To protect against unauthorised access, we use Firebase App Check and are tightening the database access rules step by step.

15. Retention

Account data is kept as long as your account exists. When you delete your account, we remove your data from our servers.
Chats without an account are deleted after 30 days.
AI request counters and server logs are deleted after 30 days.
Requests retained by OpenAI are deleted after 30 days at the latest.
Proof of consent is kept as long as we need to be able to demonstrate consent.

16. Your rights

Under the GDPR you have the right of access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20) and to object to processing based on legitimate interests (Art. 21). You can withdraw consent at any time with effect for the future (Art. 7(3)).

You can delete your account and all associated data directly in the app under Settings, "Delete account". For any other request, write to mz@calonic.com.

You also have the right to lodge a complaint with a supervisory authority (Art. 77). Our competent authority is the Bavarian Data Protection Authority (BayLDA), Promenade 18, 91522 Ansbach, Germany.

17. Changes

We update this policy when the app, our data processing or the law changes. The current version is always available in the app and at calonic.com. If the changes are significant, we will ask you to confirm again in the app.
